DMCA Policy for Pogoń Widzew Live

Pogoń Widzew Live ("we", "us", "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Pogoń Widzew Live service that are reported to us, provided such claims are reported in our designated Copyright Agent as outlined below.

Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Pogoń Widzew Live website (pogonwidzewlive.com) by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work(s) claimed to have been infringed. This could include a title, registration number, or a description of the work, along with the author and date of creation, if applicable.
  2. Identification of the material that is claimed to be infringing: Provide the specific URL(s) or other location(s) on the Pogoń Widzew Live website where the allegedly infringing material is located. This information must be specific enough to allow us to locate and remove the material.
  3. Information reasonably sufficient to permit us to contact you: This must include your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature: This can be a scanned signature or a valid electronic signature as per the E-Sign Act.

Filing a DMCA Counter-Notification

If you believe that your content, which was removed or disabled by Pogoń Widzew Live, is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Copyright Agent:

  • Identification of the material that has been removed or to which access has been disabled: Include the specific URL(s) or other location(s) where the material appeared before it was removed or disabled.
  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal court in [Jurisdiction of your choice, e.g., the judicial district where your address is located, or if your address is outside of the United States, for any judicial district in which Pogoń Widzew Live may be found], and that you will accept service of process from the person who provided the original notification of the alleged infringement.
  • Your physical or electronic signature: This can be a scanned signature or a valid electronic signature as per the E-Sign Act.

Upon receipt of a valid counter-notification, Pogoń Widzew Live will promptly forward a copy to the person who submitted the original DMCA Notice. If we do not receive notice from the original claimant that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on our system within 10-14 business days of our receipt of the counter-notification, we may, at our sole discretion, replace or restore access to the material.
